Terms of Service

These Terms of Service ("Terms") govern your use of the Dialed web application, Chrome extension, and related services (collectively, the "Service") operated by Dialed ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Account Registration

You must sign in with a Google account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 16 years old to use the Service.

2. Service Description

Dialed is a golf performance analytics platform. You upload launch monitor data (e.g., TrackMan CSV files) and the Service provides strokes gained analysis, swing scoring, AI-powered session debriefs, progress tracking, and related insights. The Service includes:

• A web application for viewing analysis and managing your data.
• A Chrome extension for importing data from TrackMan.
• AI-generated narratives and debriefs powered by third-party language models (currently Anthropic Claude).
• Optional coach collaboration features for sharing data with a connected coach.

3. Free and Pro Plans

The Service offers a free tier and a paid Pro tier. Free accounts are subject to monthly usage limits (currently 3 session uploads and 1 AI debrief per month). Pro accounts receive unlimited access to all features. We reserve the right to modify plan features, limits, and pricing with reasonable notice. Changes to pricing will not apply to your current billing period.

4. Payment and Billing

Pro subscriptions are billed monthly or annually as selected at checkout. Payments are processed by our third-party payment provider. By subscribing, you authorize recurring charges until you cancel. You may cancel at any time; access continues through the end of your current billing period. We do not offer refunds for partial billing periods.

5. Your Data

You retain ownership of all data you upload to the Service, including shot data, session records, and settings. We do not claim ownership of your data. We use your data solely to provide and improve the Service, as described in our Privacy Policy.

You may delete individual sessions at any time. You may request full account and data deletion by contacting us. Upon account deletion, all associated data will be permanently removed within 30 days.

6. AI-Generated Content

The Service uses AI to generate session debriefs, pattern analysis, and other narratives based on your shot data. AI-generated content is provided for informational purposes only and should not be treated as professional instruction. AI outputs may contain errors or inaccuracies. We are not liable for decisions you make based on AI-generated content.

7. Coach Features

If you connect with a coach through the Service, you authorize that coach to view your session data, shot data, evaluation results, and AI-generated content. You may remove a coach connection at any time, which immediately revokes their access to your data. Coaches access student data under their own agreement with the Service.

8. Third-Party Data Sources and Chrome Extension

The Service includes a Chrome extension that imports golf session data from third-party platforms such as TrackMan. By using the Chrome extension, you acknowledge and agree that:

• You are responsible for complying with the terms of service of any third-party platform from which you import data.
• Dialed is not affiliated with, endorsed by, or sponsored by TrackMan A/S or any other third-party data source.
• We do not guarantee continued compatibility with any third-party platform. Changes to third-party services may affect the Chrome extension's functionality at any time.
• You must have a valid account on the third-party platform and authorization to access the data you import.
• We are not responsible for any action taken by a third-party platform in response to your use of the Chrome extension, including account restrictions or data access changes.

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Scrape, crawl, or use automated means to access the Service beyond normal use.
• Upload malicious data or content designed to disrupt the Service.
• Resell or redistribute the Service without our written consent.

10. Availability and Changes

We strive to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice before discontinuing core functionality. If we discontinue the Service entirely, we will provide a way to export your data.

11. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with notice where practicable. You may stop using the Service and delete your account at any time. Sections 5, 11, 12, and 15 survive termination.

14. Trademarks

TrackMan® is a registered trademark of TrackMan A/S. Dialed is not affiliated with, endorsed by, or sponsored by TrackMan A/S. All other trademarks are the property of their respective owners.

15. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms or the Service will be resolved in the courts located in New York, New York.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the email associated with your account or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
